Solutions for Those Requesting Client Information
|
|
| Requesting client information is a varied and potentially complex process. ComCor staff will answer telephone inquires regarding whether a particular client is in one of our programs or not. This is a matter of public record; such information is available in other places in the criminal justice system.
Beyond that, the laws and regulations governing the release of client information get more complex. ComCor maintains written procedures that govern access to all ComCor revords. According to ComCor policies and procedures, clients may have access only to those documents in their case records that bear their signature.
Client records may be requested by clients, their attorneys, law enforcement officials, court orders and other third parties. This usually occurs only when there is a new legal proceeding, the client is leaving ComCor or is being transferred to another community corrections program.
All requests for records, including court orders, law enforcement, attorney requests, and subpoenas and releases will be referred to the ComCor records custodian, Director of Programming and Residential Services Paul Isenstadt or his designee. These requests for client records must be in writing. They will be reviewed for the appropriateness of the request and whether releasing the information will violate federal or regulatory standards. Such standards govern the release of confidential records that include (but are not limited to) medical, mental health, substance abuse and ComCor internal records. |
